Terms of service
THE WELL Co., Ltd. (hereinafter referred to as the "Company") has established the following terms and conditions regarding the use of the website operated by the Company and linked SNS services (hereinafter referred to as the "Service").
1) Scope of application and changes to these Terms
These Terms apply to the Company and users (as defined in Article 3) regarding the provision and use of the Service.

3) User

4) Membership registration

- If you engage in any of the acts listed in Article 7 "Prohibited Matters"

7) Prohibited matters
Users shall not engage in the following acts.
- Acts of applying for false registration details when registering as a member.
- Acts that interfere with the operation of this service, or other acts that may interfere with this service.
- Acts of using this service by fraudulently using a credit card
- Acts of illegally using email addresses and passwords
- Acts that cause inconvenience, disadvantage, or damage to other users, third parties, or the Company, or acts that may cause such harm.
- Acts that infringe on the trademark rights, copyrights, privacy, or other rights of other users, third parties, or our company, or acts that are likely to do so.
- Acts that violate public order and morals, or other acts that violate laws or regulations, or that may be likely to do so.
- Other acts that our company deems inappropriate.
8) Copyright etc.
Copyrights and other intellectual property rights related to the content of websites and linked SNS operated by the Company shall belong to the legitimate rights of the Company or the copyright holders of each content, unless otherwise specified in these Terms. Users may not use any information provided through this service without the prior consent of the Company or the legitimate rights holders, and may not be restricted by copyright, etc., such as personal copying by the user as permitted by copyright law. You may not use it beyond the scope that does not apply.

9) Management of member ID and password
Users shall be responsible for managing the member ID and password they have set themselves.

10) Use of user information

11) Purchase of products
Users can purchase products using this service.
If a user wishes to purchase a product, he/she shall apply to purchase the product in accordance with the method specified by the Company.
A sales contract will be established between the user and the Company when the Company sends an email to the User stating that the shipment of the purchased product has been completed in response to the application set forth in the preceding paragraph. However, even after sending the above email, we may cancel the sales contract due to inventory status or other circumstances.
After receiving the application under paragraph 2, the user cannot cancel the application.
12) Cancellation of contract
In the event of any of the following circumstances, our company may cancel part or all of the product sales contract.
- If the user violates these terms
- When circumstances arise that can be deemed to have put the user's ability to pay in jeopardy.
- If the product is out of stock, discontinued or the product cannot be easily secured.
- If delivery is not possible due to unknown registered address, long-term absence, or lapse of the receiving period due to absence, etc.
Notwithstanding the provisions of the preceding paragraph, if there is any fraudulent or inappropriate behavior regarding the use of this service, our company may cancel or terminate the sales contract or take other appropriate measures.
Even if the sales contract is canceled pursuant to Paragraphs 1 and 2, the Company will not be liable for damages to the User. In addition, if the Company has already shipped the product, the Company is not obligated to refund the product price to the user.
13) Payment
The amount you pay when purchasing a product is the total amount of the product purchase price, shipping fee, handling fee, and consumption tax. If the full amount is not paid by the payment deadline using the payment method selected at the time of ordering, the sales contract may be canceled or canceled at the user's risk without notice from us.
Depending on the content of the product ordered through this service or the age of the user, there may be payment methods that cannot be used.
In the case of payment by credit card or other payment method provided by a third party, even if a dispute arises between the user and the third party such as the credit card company regarding prepayment, etc., both parties shall resolve it. Our company does not take any responsibility.
14) Product returns, etc.
Products cannot be returned unless the product is damaged during shipping, is defective, or in other cases approved by our company.
If the Company approves the return, the User shall return the item in accordance with the method specified by the Company.
Even if the Company approves the return, if the User does not return the item in accordance with the method specified by the Company and cannot be contacted within 30 days after the Company contacts the User, the entire order amount will be borne by the User.
If a product shipped from our company does not arrive at the address specified by the user and is returned to us, the user will be responsible for re-shipping costs. In order to receive the product without delay, the user must check the location of the product on the package tracking website.
15) Management of user information
Users shall be responsible for the comments, photos, and any other information they send on this service.
When transmitting comments, photos, or any other information on this service, users must not engage in the following acts or acts that may be likely to occur.
- Acts that infringe on the copyrights and other rights and interests of our company or third parties
- Acts that violate the honor, trust, or privacy of the Company, other members, or other third parties, or interfere with business operations.
- Acts that are used for commercial purposes such as advertisements and promotions, or for solicitation of membership in a specific ideology or religion.
- Acts of transmitting information that contains content that contradicts the facts in whole or in part
- Acts of transmitting content that violates Japanese or applicable foreign laws.
- Other acts deemed inappropriate for the operation of this service
The Company will review the content of comments, photos, and any other information sent by users, and may delete any comments, photos, or other information submitted by the User at its discretion without any particular reason or notice to the User.
The Company may, at its discretion and without any notice, deny users access to all or part of the website operated by the Company.
The Company may freely reprint, quote, distribute, or otherwise use comments, photos, and any other information posted by users on this service free of charge without notifying the users. Users shall not be able to claim any rights against this.
16) Suspension of Service
In order to maintain the operational status of this service, our company may suspend all or part of the provision of this service without prior notice to users if any of the following items apply.
- When necessary for regular system maintenance or emergency maintenance
- If system operation becomes difficult due to fire, power outage, sabotage by a third party, etc.

17) Other disclaimers
If the Company is obligated to notify the user, the Company shall notify the user by sending an email to the user's pre-registered email address or by displaying the notification on the website operated by the Company. At the time of purchase, the obligation is deemed to be fulfilled by delivering the product to the destination specified by the user.
The Company shall not be liable in any way for any damage, loss, disadvantage, etc. related to the use of this Service or the products sold through this Service, other than those stipulated in the preceding article, regardless of the legal cause of claim.
Our company shall be exempted from liability by processing affairs in accordance with the user's registered information.
The Company shall not be liable for any damages, losses, disadvantages, etc. arising from the use of this Service under any circumstances, regardless of the legal cause of claim.
If a user causes damage to another user or a third party by using this service, the user shall resolve the matter at his or her own responsibility and expense, and the Company shall not be liable for any damages. We will not cause any inconvenience.
When changing a user's password, the Company shall be exempted from liability by verifying the user's identity using a method specified by the Company.
18) Others
In principle, our company and users will communicate via email and telephone.
In the event that a problem arises regarding the use of this service that cannot be resolved in accordance with these Terms, the Company and the user shall discuss the matter in good faith and resolve it.
If a lawsuit arises regarding the use of this service, the district court with jurisdiction over the location of our company will be the court of first instance.
19) Overseas delivery
When the product ordered by the user is shipped from our company, the ownership and risk of the product will be transferred from our company to the user. Users must check the delivery status of their products themselves. In addition, we cannot accept changes or cancellations after the product has been shipped, except in the case of a defective or incorrect product.
The time required for delivery depends on the delivery service and customs situation in each country, as well as natural disasters and accidents. We cannot guarantee delivery times.
Depending on the country or region where the product is being delivered, customs duties, VAT (value added tax), customs fees, etc. may be imposed by the government or local delivery company, and may be required separately when receiving the package.
Our company cannot guarantee returns, exchanges, or refunds in the event of damage or loss due to customs inspection.
If you receive a damaged or defective item, please retain the item and all packaging materials for inspection by the shipping carrier. Additionally, the user must notify the Company within one week of receiving the product.
Depending on the country or region, depending on the delivery method you choose, the delivery location may be a local delivery service or customs office rather than the delivery address, but the recipient is responsible for receiving the delivery. If you do not hear from your local shipping service or customs office when your item arrives, please contact your local shipping service or customs office with your package tracking number.
If the package is returned to us, the user will be responsible for the full cost of reshipping. Returned packages will be resent using our designated delivery service, and the reshipping fee will be charged at the delivery service's designated rate.
Even if refunds or returns are possible under these terms and conditions, refunds or changes cannot be made after 180 days have passed from the date of your order.
